California evictions starting up again?

Can landlords start evictions in California? As reported last week, the Judicial Council met and made an important decision: as of Friday, 8/14, the Judicial Council of California (which governs all the courts in California) put an end date to its eviction moratorium emergency rule, which has been preventing ALL new residential and commercial evictions from moving forward. The emergency rule will sunset on 9/1 and the courts will be able to start releasing summons for unlawful detainers starting 9/2. Many municipalities - who created their own eviction regulations for non-payment of rent due to COVID-19 - are covered by the statewide eviction moratorium that was extended by Newsom to 9/30...so there will still be a reprieve for those who can’t pay rent due to COVID-19 in some parts of California.

The biggest reason for this ruling by the Judicial Council was pressure from critics who said that the judicial branch was overstepping its boundaries into areas that the legislative branch is supposed to govern. So what is the legislative branch up to? California legislators are negotiating to get a bill in place that addresses California evictions due to nonpayment of rent due to COVID-19, like AB 1436 or SB 1410. In the middle of a pandemic, we also had the important deadline for landlords for the Tenant Protection Act of 2019 (AB 1482). If you know any landlords who missed this important deadline, here is an update on what to do…Landlords, did you miss the AB 1482 deadline?

Curious about a new stimulus package? Congress is on holiday so there won’t be any new developments on a stimulus package until sometime in mid to late September. In case you’re wondering, the Senate comes back from vacation on Tuesday, September 8, the day after the Labor Day, and the House will be on vacation until Monday, September 14.
